General Terms and Conditions
§ 1 Scope of application, customer information
The following General Terms and Conditions (GTC) govern the contractual relationship between Jochen-Christian Schwedler and consumers and entrepreneurs who purchase goods via our store Barcodeetiketten.com. Conflicting or deviating terms and conditions are not recognized by us. The contract language is German.
§ 2 Conclusion of contract
(1) After entering your personal data, successfully completing the individual order steps and clicking on the corresponding button in the final step of the order process, you submit a binding purchase offer for the goods contained in the shopping cart. Before submitting the order, you have the opportunity to recognize any input errors and correct and/or change them using the correction function.
(2) Confirmation of receipt of the order follows immediately after the order has been sent. This automatic confirmation of receipt merely documents that we have received the order and does not constitute acceptance of the order.
(3) We are entitled to accept your order within 2 days of receipt by sending an order confirmation in writing or in text form (e.g. email), in which you are requested to pay or the delivery of the goods is confirmed.
(4) A binding contract can also be concluded beforehand if you select an online payment method and make the payment immediately after sending the order. In this case, the contract is concluded at the time when the corresponding payment service provider confirms the execution of the payment instruction. The text of the contract (order) is saved. You can view the general terms and conditions of contract (GTC) at any time on our website and save them on your computer. The specific order data will be sent to you by email.
(5) You can submit complaints, claims and other warranty claims to the address given in the legal notice.
§ 3 Customer information: Storage of the contract text
Your order with details of the concluded contract (e.g. type of product, price, etc.) will be stored by us. We will send you the GTC, but you can also access the GTC at any time via our website after conclusion of the contract. As a registered customer, you can access your past orders via the customer login area (your account).
§ 4 Customer information: Correction note
You can correct your entries at any time before submitting the order using the delete button. We will inform you of further correction options as you progress through the ordering process. You can also end the order process completely at any time by closing the browser window.
§ 5 Retention of title
The object of purchase remains our property until full payment has been made.
§ 6 Statutory liability for defects and limitation period
(1) Statutory liability for defects
Our goods are subject to statutory warranty rights.
(2) Warranty towards consumers for used goods
Your claims for defects in used goods shall become time-barred one year after delivery of the item sold to you. Excluded from this provision are claims for damages, claims for defects that we have fraudulently concealed and claims arising from a guarantee that we may have assumed for the quality of the item. The statutory limitation periods apply to these excluded claims. In the event of a guarantee period, the longer period shall apply in favor of the buyer.
(3) Warranty towards entrepreneurs
Your warranty claims due to defects in the purchased item expire one year after the transfer of risk. The following claims are excluded from this regulation
- for damages
- due to fraudulently concealed defects
- from any guarantee given
- recourse according to §§ 445a, 478 BGB
- due to defects in building materials and components that have been used for a building in accordance with their normal use and have caused its defectiveness
The statutory limitation periods shall apply to these excluded claims. In the event of a warranty period, the longer period shall apply in favor of the buyer.
§ 7 Limitation of liability
We exclude liability for slightly negligent breaches of duty insofar as these do not relate to material contractual obligations, damage resulting from injury to life, limb or health, guarantees or claims under the German Product Liability Act (ProdHaftG). The same applies to breaches of duty by our vicarious agents and our legal representatives. Essential contractual obligations include in particular the obligation to hand over the item to you and to procure ownership of it for you. Furthermore, we must provide you with the item free of material defects and defects of title.
§ 8 Commercial place of jurisdiction
The exclusive place of jurisdiction for all disputes arising from this contract is our registered office if you are a merchant.
